Boston Scientific Scimed, Inc., v. Cordis Corporation

根據之前的KSR判例,CAFC認為透過單一前案中所揭露的特徵作為證據,仍支持「顯而易見」的進步性核駁理由
Boston Scientific Scimed, Inc.擁有US6,120,536專利,控告Cordis Corporation的產品侵權,一如KSR v. Teleflex案例,同樣Cordis公司於侵權審理階段提出US6,120,536專利無效,尤其是其中Claim 8:

Claim 1:(非專業翻譯,請參考原文較佳)
是一種醫療裝置,有一部分植入病人的身體,一部分為金屬、一部分由生物主動材料(biologically active material)所塗布,此塗布材料包括有人造橡膠的底漆(undercoat),與部份含蓋此底漆的包覆層(topcoat),包覆層有雙穩、不會形成血栓的材料,以提供長時間不會形成血栓的功效。

Claim 6:此醫療裝置是可延伸的支架。
Claim 8:此支架包括具有開口(open ends)與晶格壁結構的管狀體,而上述塗布層與管壁結構(或說形狀)一致。

8. The device of claim 6 wherein the stent comprises a tubular body having open ends and an open lattice sidewall structure and wherein the coating conforms to said sidewall structure in a manner that preserves said open lattice.

上述範圍即為此例的主要爭議範圍,Cordis公司則引用另一件美國專利US5,545,208(Wolff)中的Fig. 3B(layer 14 covered by second layer of polymer 15), Fig. 4所揭露的聚合物支架,認為兩張圖的結合(如下有陰影的那張,此圖為CAFC自行結合畫出)已揭露上述範圍中的塗布層與包覆層
此案在地方法院階段並無接受Cordis公司認為專利無效的請求,但是進入CAFC,則有此不同的結果,原因是CAFC認為此領域技術人員應有結合這兩張同一專利兩個實施例的合理動機,其強調「combining two embodiments disclosed adjacent to each other in a prior art patent does not require a leap of inventiveness.」,亦即結合習知技術兩個相鄰的圖案並非需要多有創造力,也就是一般人可以做到的


所以,此侵權爭議案在系爭專利US6,120,536被判為無效時,也就終止了

結語:
上述Wolff案中的兩個圖是不同的實施例,且說明書是揭露有多層的結構,而並非限於圖中簡單的兩層結構而已,但圖示如此,且因為擺在一起,竟然也可以被認為有結合的動機。
其實Boston Scientific Scimed, Inc.曾經爭論過KSR(有否動機變成很重要的判斷根據)與本案無關,原因是Cordis並未結合任何引證案,而是用同一件案中的推論而已,並且,Boston Scientific Scimed, Inc.曾經提過解決長久需要的問題(long-felt need)的Secondary Consideration來反駁,但是,CAFC仍認為此二次要因無法克服Wolff案讓Claim 8顯而易見中足夠強的「初步印象」(strong prima facie),CAFC的結論也確實是被KSR的進步性判斷影響了。

了解辭彙編撰者(LEXICOGRAPHER)

解讀專利文件時, 原則是先從內部證據開始理解, 再參考外部證據
所謂內部證據, 就是發明人自行於專利說明書中定義名詞, 除了因為需要而自己創造的名詞外, 應用到習知已用過的名詞, 都可自行成為一個"辭彙編撰者(LEXICOGRAPHER)"

可參考MPEP 2111.01, 其規範權利範圍撰寫時的"理想"原則, 雖是理想, 卻也是一個撰寫者應要知道的, 這樣可以推論, 每個專利, 或說發明, 其實都是由"習知技術"的組合形成的, 除了少數的開創性的發明, 其實其中各元件"個別來看"應"不是新的", 而是組合起來產生具有專利性的發明

  1. THE WORDS OF A CLAIM MUST BE GIVEN THEIR "PLAIN MEANING" UNLESS SUCH MEANING IS INCONSISTENT WITH THE SPECIFICATION
    除非意思與說明書內容不符, 要不然申請專利範圍應給與清楚明白的意思(解釋申請專利範圍時, 應該由當中的意思解讀出清楚的意思, 這與名詞的命名有很大的關係)Although claims of issued patents are interpreted in light of the specification, prosecution history, prior art and other claims, this is not the mode of claim interpretation to be applied during examination. During examination, the claims must be interpreted as broadly as their terms reasonably allow. In re American Academy of Science Tech Center, 367 F.3d 1359, 1369, 70 USPQ2d 1827, 1834 (Fed. Cir. 2004) (The USPTO uses a different standard for construing claims than that used by district courts; during examination the USPTO must give claims their broadest reasonable interpretation in light of the specification.). This means that the words of the claim must be given their plain meaning unless the plain meaning is inconsistent with the specification. In re Zletz, 893 F.2d 319, 321, 13 USPQ2d 1320, 1322 (Fed. Cir. 1989) (discussed below); Chef America, Inc. v. Lamb-Weston, Inc., 358 F.3d 1371, 1372, 69 USPQ2d 1857 (Fed. Cir. 2004) (Ordinary, simple English words whose meaning is clear and unquestionable, absent any indication that their use in a particular context changes their meaning, are construed to mean exactly what they say.
    雖然申請專利範圍的解讀(如侵權鑑定)會引用說明書內容來解釋, 但是在"審查"時卻是僅以申請專利範圍的文字的廣度來解釋, 也就是, 侵權鑑定從"嚴", 專利審查從"寬"

  2. IT IS IMPROPER TO IMPORT CLAIM LIMITATIONS FROM THE SPECIFICATION
    由說明書引入限制申請專利範圍的限制是不適當的(申請專利範圍應該由其中字義就可以了解範圍, 應無需由說明書內容來解釋)
    "Though understanding the claim language may be aided by explanations contained in the written description, it is important not to import into a claim limitations that are not part of the claim. For example, a particular embodiment appearing in the written description may not be read into a claim when the claim language is broader than the embodiment." Superguide Corp. v. DirecTV Enterprises, Inc., 358 F.3d 870, 875, 69 USPQ2d 1865, 1868 (Fed. Cir. 2004). See also Liebel-Flarsheim Co. v. Medrad Inc., 358 F.3d 898, 906, 69 USPQ2d 1801, 1807 (Fed. Cir. 2004)(discussing recent cases wherein the court expressly rejected the contention that if a patent describes only a single embodiment, the claims of the patent must be construed as being limited to that embodiment);< E-Pass Techs., Inc. v. 3Com Corp., 343 F.3d 1364, 1369, 67 USPQ2d 1947, 1950 (Fed. Cir. 2003) ("Interpretation of descriptive statements in a patent's written description is a difficult task, as an inherent tension exists as to whether a statement is a clear lexicographic definition or a description of a preferred embodiment. The problem is to interpret claims 'in view of the specification' without unnecessarily importing limitations from the specification into the claims."); Altiris Inc. v. Symantec Corp., 318 F.3d 1363, 1371, 65 USPQ2d 1865, 1869-70 (Fed. Cir. 2003) (Although the specification discussed only a single embodiment, the court held that it was improper to read a specific order of steps into method claims where, as a matter of logic or grammar, the language of the method claims did not impose a specific order on the performance of the method steps, and the specification did not directly or implicitly require a particular order). See also paragraph *>IV.<, below. **>When<>35 U.S.C. 112, 6th paragraph (often broadly referred to as means or step plus function language)**, the specification must be consulted to determine the structure, material, or acts corresponding to the function recited in the claim. In re Donaldson, 16 F.3d 1189, 29 USPQ2d 1845 (Fed. Cir. 1994) (see MPEP § 2181- § 2186).
    通常, 權利範圍的解讀是比說明書內容來的寬的
    判例中顯示, 如果說明書僅揭露一個實施例, 法院可能會將此一僅有的實施例讀進權利範圍, 但是稍後的判例卻指出這是不恰當的, 比如實施例揭露一個方法流程, 但權利範圍中步驟的解釋卻不能限定於實施例的順序
    (實務上, 中國專利局對此卻是異常嚴格, 如果只有一個實施例, 通常在審查階段就會被要求作為範圍的"必要特徵", 而要求限制)

  3. "PLAIN MEANING" REFERS TO THE ORDINARY AND CUSTOMARY MEAN-ING GIVEN TO THE TERM BY THOSE OF ORDINARY SKILL IN THE ART
    所謂的"plain meaning"是指該發明所屬領域的技術人員的一般認知或是慣用的意義(申請專利範圍中的意義, 應由該發明所屬技術領域的人可以用一般知識去理解, 而無需過度解釋, 或是引用說明書內容來看)
    "The ordinary and customary meaning of a claim term is the meaning that the term would have to a person of ordinary skill in the art in question at the time of the invention. "In the absence of an express intent to impart a novel meaning to the claim terms, the words are presumed to take on the ordinary and customary meanings attributed to them by those of ordinary skill in the art."). In construing claim terms, the general meanings gleaned from reference sources, such as dictionaries, must always be compared against the use of the terms in context, and the intrinsic record must always be consulted to identify which of the different possible dictionary meanings is most consistent with the use of the words by the inventor.

  4. APPLICANT MAY BE OWN LEXICOGRAPHER
    專利權人(發明人)可為自己的辭彙編撰者(撰寫說明書時, 可依需要自行定義新的名詞)
    An applicant is entitled to be his or her own lexicographer and may rebut the presumption that claim terms are to be given their ordinary and customary meaning by clearly setting forth a definition of the term that is different from its ordinary and customary meaning(s). See In re Paulsen, 30 F.3d 1475, 1480, 31 USPQ2d 1671, 1674 (Fed. Cir. 1994) (inventor may define specific terms used to describe invention, but must do so "with reasonable clarity, deliberateness, and precision" and, if done, must "'set out his uncommon definition in some manner within the patent disclosure' so as to give one of ordinary skill in the art notice of the change" in meaning) (quoting Intellicall, Inc. v. Phonometrics, Inc., 952 F.2d 1384, 1387-88, 21 USPQ2d 1383, 1386 (Fed. Cir. 1992)). Where an explicit definition is provided by the applicant for a term, that definition will control interpretation of the term as it is used in the claim. Toro Co. v. White Consolidated Industries Inc., 199 F.3d 1295, 1301, 53 USPQ2d 1065, 1069 (Fed. Cir. 1999) (meaning of words used in a claim is not construed in a "lexicographic vacuum, but in the context of the specification and drawings"). Any special meaning assigned to a term "must be sufficiently clear in the specification that any departure from common usage would be so understood by a person of experience in the field of the invention." Multiform Desiccants Inc. v. Medzam Ltd., 133 F.3d 1473, 1477, 45 USPQ2d 1429, 1432 (Fed. Cir. 1998). See also Process Control Corp. v. HydReclaim Corp., 190 F.3d 1350, 1357, 52 USPQ2d 1029, 1033 (Fed. Cir. 1999) and MPEP § 2173.05(a). The specification should also be relied on for more than just explicit lexicography or clear disavowal of claim scope to determine the meaning of a claim term when applicant acts as his or her own lexicographer; the meaning of a particular claim term may be defined by implication, that is, according to the usage of the term in >the<>Phillips v. AWH Corp., *>415 F.3d 1303<, 75 USPQ2d 1321 (Fed. Cir. 2005) (en banc); and Vitronics Corp. v. Conceptronic Inc., 90 F.3d 1576, 1583, 39 USPQ2d 1573, 1577 (Fed. Cir. 1996). Compare Merck & Co., Inc., v. Teva Pharms. USA, Inc., 395 F.3d 1364, 1370, 73 USPQ2d 1641, 1646 (Fed. Cir. 2005), where the court held that patentee failed to redefine the ordinary meaning of "about" to mean "exactly" in clear enough terms to justify the counterintuitive definition of "about." ("When a patentee acts as his own lexicographer in redefining the meaning of particular claim terms away from their ordinary meaning, he must clearly express that intent in the written description.").
    權利範圍允許有自行定義的內容(不同於慣用語), 但是說明書與權利範圍本身語言要有足夠清楚的定義

比如時下常用的"online"一詞, 在一般字典是找不到的, 但現在卻是常用的詞, 通常是指"在網路上", 在未有網路時, 也可指有關"排列"的意思, 所以最初使用的人必須是自己的LEXICOGRAPHER

自己就無聊用關鍵字在uspto資料庫找發明名稱有"online"的核准專利, 目前共有624件核准專利名稱有online的, 但是看看專利號碼, "7"開頭的, 也就是近2-3年的專利, 也可說是網路盛行的這幾年, 就佔了278件, 大約瀏覽了一下這些專利名稱, 確實都與網路脫不了關係, 如果回朔到第一個發明名稱有"online"的核准專利, 則是1982年IBM申請的第4,483,001號專利, 若沒錯的話, 當時應該不會有什麼跟網路有關的專利才對, (1983年才有TCP/IP的概念), 看了一下內容, 這篇專利是在講電腦資料儲存排列在記憶體的技術


再舉一例, "google"一詞已經是字典上有的字了, 意思是"網路上搜尋"的動詞, 但本來只是個"拼錯"的字, 但現在, 或許不用在專利文件上解釋, 即為一般知識的人可以知道
聽說Google的命名也是一個錯誤, 本來那個搜尋引擎應該是稱為"Goggle", 是"眼睛轉動"的意思, 若是用於搜尋器來說, 也算合理, 現在名聲大到變成字典字, 也就是"外部證據"常用的證據, 在撰寫說明書或是權利範圍時應可直接用於作為網路搜尋的動詞, 不必多做解釋

About Claims XVII - 冠詞用法

當審查意見書提到「無前述基礎(insufficient antecedent basis)」的元件時,可能也是錯誤使用「先行詞(Antecedent)」的問題由一般英文文法即知,"the"或"said"為定冠詞、"a"或"an"為不定冠詞

參考Landis「Antecedents; Indefiniteness」一章,權利範圍中有以下幾種使用定冠詞或不定冠詞的情況:
  1. 在第一次提到一個元件(element)時,該元件名稱前不應用"the"或"said",應用"a"或"an";
  2. 因為複數名詞沒有不定冠詞,故第一次出現時,不使用冠詞
  3. 複數名詞可冠上數量,如two legs
  4. 冠上數量的複數名詞重複出現時,應冠上"the"或"said",如the two legs
  5. 使用"means for"來界定元件時,不用定冠詞,也不用不定冠詞
不適當的冠詞用法:
  1. the或said對前後提到的同一元件來說,就擇一使用,不要混用
  2. 非第一次記載的元件用不定冠詞時,會產生double inclusion的問題
  3. 前後引用的相同元件不要用不同的名詞
  4. 前後引用的相同元件,也不要突然新增沒出現的形容詞,如第一次出現a gear,第二次不要就使用the plastic gear,應用其他方式描述,如the gear is plastic
  5. 在可能產生混淆的語句上,不使用不明確的代名詞,如which, that或是其他代名詞it, they等

若發生上述冠詞的用法錯誤時,常遭遇違反美國專利法第112條規定的核駁理由,理由是不明確的權利範圍,通常透過修正可克服,當然,客戶一定是不爽的
上述問題不僅發生在同一個權利範圍中,也應用於依附於其他範圍的附屬項中

一個不足前述基礎(insufficient antecedent basis)的核駁會引用美國專利法第112條第2段,認為該項範圍沒有特別指出該發明的權利標的(failing to paticularly point out and distinctly calim the subject matter),列舉一例,此處核駁理由就是因為冠詞錯誤使用造成的:

KSR v. Teleflex案簡單描述

因為KSR判例,讓USPTO審查進步性時,有了更多發揮,或說主觀判斷的空間
理由是,KSR判例前,審查委員為了要證明一件專利申請案中的發明為「顯而易知」(103(a))
需要引用一件前案加上「公知常識」的判斷,或兩件以上前案的組合,證明該案組合可以teach, suggest or give motivation(TSM)該專利申請案,予以核駁

從1966年Graham v. John Deere Co. 判例中,最高法院建立了一個判斷「顯而易知」的原則:
1. Determining the scope and contents of the prior art
2. Ascertaining the differences between the prior art and the claims at issue
3. Resolving the level of ordinary skill in the pertinent art
4. considering objective evidence present in the application indicating obviousness or nonobviousness

上述所謂的客觀證據(objective evidence),就是希望能夠降低審查委員給人的主觀判斷,實務上,審查委員常引用兩件以上的專利(習知技術),證明該專利申請案中權利範圍中的元件為各引證案中的元件間簡單的組合,認真一點的審查委員會用類似新穎性的比對一樣,用一主要的引證案逐項、逐個元件來對應,像是畫個Claim chart的方式,如果有對應不及的(要不然就是新穎性了),會用另一或以上的輔助前案對應沒有被主要引證案對應到的元件

但是經KSR判例之後,判斷「顯而易見」的方式有了改變,最高法院提出一些規則,符合的即缺乏進步性,這讓進步性的判斷產生了不少變化,是否該發明是「obvious to try」就變成很大的問題:
  1. 發明中一般元件的結合如果沒有產生超出預期的結果,為顯而易見的技術
  2. 相對於一個發明,如果一般技術人員能實踐可預期的變化時,則不符合103的進步性規定
  3. 發明中的方法之一在發明的時間為已知問題,且明顯有專利範圍包含的解決方案,不能准予專利
「KSR」是間供應汽車油門、煞車組件的供應商,原告Teleflex則是擁有專利US6,237,565的專利權人,Teleflex控告KSR侵害此專利,而KSR反控該專利案Claim 4(主要爭議項)無效,認為該項範圍過廣,涵蓋到習知技術,此爭議到最高法院,核定Claim 4不具進步性
4. A vehicle control pedal apparatus (12) comprising:
a support (18) adapted to be mounted to a vehicle structure (20);
an adjustable pedal assembly (22) having a pedal arm (14) moveable in force and aft directions with respect to said support (18);
a pivot (24) for pivotally supporting said adjustable pedal assembly (22) with respect to said support (18) and defining a pivot axis (26); and
an electronic control (28) attached to said support (18) for controlling a vehicle system;
said apparatus (12) characterized by said electronic control (28) being responsive to said pivot (24) for providing a signal (32) that corresponds to pedal arm position as said pedal arm (14) pivots about said pivot axis (26) between rest and applied positions wherein the position of said pivot (24) remains constant while said pedal arm (14) moves in fore and aft directions with respect to said pivot (24).

代表圖顯示汽車油門踏板的結構

此案揭露一種汽車油門踏板控制機構,其中具有可調的踏板組成(22),其中包括有可前後移動的踏板臂(14),此機構再包括一連接於支架(18)的電子節流閥控制裝置(28),用以控制引擎節流閥(throttle),此汽車油門踏板控制機構即透過電子節流閥控制裝置(28)依據樞軸(24)的作動產生訊號,對應調整踏板臂(14)的位置,而無需移動此電子節流閥控制裝置(28)。此專利達到簡化汽車油門踏板控制機構的目的。

Asano案同樣揭露一種汽車可調式的踏板結構,雖與Teleflex案中的圖式有差異,但同樣具有可前後調整的踏板臂與其概念,與Teleflex的差異僅在於是否電子感應樞軸的作動來進行調整,但Claim 4的範圍頗大,範圍觸及習知技術,KSR即結合GM ETC的電子感應器,請看上述下載影片,證明Teleflex中的Claim 4為此簡單結合,不具進步性


Teleflex v. KSR的訴訟過程複雜,涉及CAFC與專利局的判斷,還有最高法院認為CAFC使用TSM過於僵化的問題,但結果是認為上述Claim 4在習知技術的基礎下為簡單嘗試(obvious to try)不具進步性可參考http://enpan.blogspot.com/2008/12/obvious-to-try.html

此判例產生的結果是,結合多種習知技術的「組合發明」將落於「沒有產生超出預期的結果」、「一般技術人員能實踐可預期的變化」或是「欲解決已知問題」,而難以獲得專利

芭比娃娃

最近要跟一群小朋友介紹專利、商標是甚麼?(老師定時邀請一些人介紹各種職業,這次是講專利商標)
算是一個小小扎根的機會

在準備講義的時候,為了要圖文並茂、淺顯易懂,雖我不是很懂商標,但這部份卻是比較簡單準備的,因為每個人,尤其是小朋友,日常生活中最多是接觸「商標」,大街小巷斗大的招牌、品牌,從麥當勞、7-11、open講、可樂、穿的、父母身上的名牌、開的車,只要仔細一想,一下子題材都出來了!
反倒是「專利」,比較找不到容易懂的東西,最後發現,可以從「商標」的介紹轉入「專利」,比如「芭比娃娃」或是「Barbie」絕對是個知名商標

但是整個娃娃的結構、動作關節、甚至是特殊功能,就是「專利」申請的標的,當然描述文字要更簡單...!

Barbie娃娃是專利權人是一間名為Mattel的公司
查閱此公司的專利,看到不少不算是娃娃(doll)的專利,娃娃的結構也算是五花八門

美國專利分類號(classification)

美國專利分類號(classification)提供比IPC多樣化的分類,並聽說幾年會有一次修正(re-classification),由於多數國家依循IPC分類,變動的話影響甚大,但是美國專利自己的分類卻相對彈性不少

USPTO網站中提供很詳細的美國專利分類號的細節,如下表顯示各種分類的點選按鈕,並提供與IPC間的關係


使用者可透過以下介面搜尋特定類別的內容,非常方便:

專利檢索的漏洞!

專利檢索可以滴水不漏嗎?
難矣!

就以專利權人為關鍵字來檢索,就必須考慮到該公司的其他可能名稱,甚至不相關的子公司名稱

以台積電為專利權人的相關專利為例,台積電在美國的Assignee Name可為:
TSMC-ACER Semiconductor Manufacturing Corporation
TSMC-Acer Semiconductor Manufacturing Company
TSMC-Acer Semiconductor Manufacturing Inc.

MPEP 714.02 Must Be Fully Responsive
規定應完整答覆審查意見

進行審查意見的答覆時,應注意要針對審查委員提出的問題切題回應,並非能含糊帶過,即使申請人認為審查委員仍有誤謬之處,仍需回應,否則仍難以順利獲准專利。
曾經處理過審查委員認為答辯內容不切題,並未針對問題回應的Office Action,審查委員要申請人參考MPEP 714.02,摘錄如下:

此段即引用CFR中回應non-final OA的規定
37 CFR 1.111 Reply by applicant or patent owner to a non-final Office action.

(a)(1)若申請人認為USPTO提出的審查意見有誤,而申請人認為申請案應具專利性,應回應USPTO,並要求重新考慮或是審查(reconsideration or futher examination),並可提出內容修正(a)(2)於提出答辯後,不能再補充理由,若需補充內容,僅限於以下幾種狀況:
(A)刪除範圍
(B)採用審查委員建議
(C)使申請案能核准的情況
(D)在第一次答辯後,依據官方要求的回應
(E)格式、文法上的修正
(F)提出訴願

(A) Cancellation of a claim(s);
(B) Adoption of the examiner suggestion(s);
(C) Placement of the application in condition for allowance;
(D) Reply to an Office requirement made after the first reply was filed;
(E) Correction of informalities (e.g., typographical errors); or
(F) Simplification of issues for appeal.

(b)為了能夠讓審查委員進一步進行審查,而做出不同的考慮或意見,申請人應指出審查委員的錯誤,並針對每個審查理由作出回應,其中針對各權利範疇,為何能夠在引證案的阻卻下具有專利性提出答辯,答覆內容應使申請案能夠重新審理。
一般認為不需明確指出權利範圍的語句與引證案的差別是不符本段的規定的。

(c)針對核駁理由、舉發案(reexamination)權利範圍的修正,申請人(或專利權人)應清楚指出面對引證案的新穎性(具專利性)之處,為何能夠避免引證案阻卻的理由。

德國專利局的Oral Hearing

德國專利局的Oral Hearing(或可翻為口審、面詢)

德國專利法授予審查委員在有必要時(做出處分/審定前)可要求申請人或發明人參與Oral Hearing,通常也是委任代理人參加,以釐清案情。

歐洲多數國家有時會收取幾年的年費後,突然來個核駁審定,或是一個Oral Hearing的要求。在一般情況下,審查委員會在做出最終核駁前發出summon of a hearing,要求申請人或代理人參加面詢,此時,參與的人可提出曾經提出的書面答辯,或是新增答辯內容與權利範圍的修正,以利於面詢時讓審查委員做出不同的審查意見。

若此時不參與面詢,則審查委員將會做出最終決定,通常是遭受最終核駁,專利申請案將致放棄,申請人此時僅能提出上訴(Appeal)。

德國專利局幾年前啟動Oral Hearing也是讓審查程序更接近EPC的規定。

順道一提的是,因為來自證人、專家的「面詢」是審查委員審定專利有效、無效的一種重要的資訊來源,故EPC Article 116中有規定啟動Oral Proceedings的情況:
  1. 在審查有需要時,或是任何人請求下,EPO可啟動面詢程序,但EPO仍可在提出面詢者與程序對象相同時(申請人自己提出面詢要求)拒絕面詢要求
  2. 當EPO認為有面詢需要,或是將要核駁EPO申請案時,可要求面詢
  3. 在審查階段前的面詢並非公開
  4. 在EPO申請案公開後的面詢程序是公開的

從專利US7479949學布局策略

剛好得知蘋果最近獲得一項重要的觸控裝置專利,就花點時間研究一下

蘋果電腦的US7479949觸控螢幕裝置專利申請於2008年4月11日,2008年12月29日領証。此案策略是由五件不同日期的臨時申請案(provisional application)開始,整個歷程整理如下,可供專利申請的策略規劃參考:
  1. 順序提出多件臨時申請案,一件當然也是OK:
    60/937,991,申請日為06-29-2007
    60/937,993,申請日為06-29-2007
    60/879,469,申請日為01-08-2007
    60/879,253,申請日為01-07-2007
    60/824,769,申請日為09-06-2006
  2. 於最早臨時申請案的一年內提出正式申請案11/850,635(申請日為09-05-2007,恰於最早那件的前一天送件)
  3. 此正式案並未應用「加速審查」,再接著提出延續案12/101,832

  4. 此延續案請求「加速審查」(Accelerated Examination Request),加速審查需申請人自行提出新穎性與進步性的檢索結果與審查支援文件(Examination support document),同時提出Petition for 12-month Accelerated Exam

  5. 於04-11-2008提出事先審查檢索(Statement of preexamination search)同時提出審查支援意見(Examination support document),這是加速審查的必要文件,USPTO由此文件判斷新穎性與進步性,如果內容並未誠實或是不夠充分,USPTO能撤回加速審查的申請,進入一般審查階段,且不會退費



  6. Apple公司接著再於06-12-2008提出另一份審查支援文件(Examination support document),期間更多次提出IDS
  7. 同時提出Terminal Disclaimer(期末拋棄),以與母案能終結權利,克服可能的阻礙
  8. USPTO於09-26-2008發出核准通知
  9. 此於一年內獲准專利
在此358頁的專利文件中,內含近300張圖式,鉅細靡遺地揭露了觸控操作的細節與圖形介面,可能是企圖讓往後需要特定應用的專利無處可容,猜測為將來增加更多延續案佈下了暗樁,此母案即成為佈置其專利地圖的主要母案之一。本案主要範疇如下,雖為硬體的標的,然其中保護了執行於硬體中的軟體程式:
1. A computing device, comprising:
a touch screen display;
one or more processors;
memory; and
one or more programs, wherein the one or more programs are stored in the memory and configured to be executed by the one or more processors, the one or more programs including:
instructions for detecting one or more finger contacts with the touch screen display;
instructions for applying one or more heuristics to the one or more finger contacts to determine a command for the device; and
instructions for processing the command; wherein the one or more heuristics comprise:
a vertical screen scrolling heuristic for determining that the one or more finger contacts correspond to a one-dimensional vertical screen scrolling command rather than a two-dimensional screen translation command based on an angle of initial movement of a finger contact with respect to the touch screen display;
a two-dimensional screen translation heuristic for determining that the one or more finger contacts correspond to the two-dimensional screen translation command rather than the one-dimensional vertical screen scrolling command based on the angle of initial movement of the finger contact with respect to the touch screen display; and
a next item heuristic for determining that the one or more finger contacts correspond to a command to transition from displaying a respective item in a set of items to displaying a next item in the set of items.

Restrictions or/and Election的實例

由美國審查意見的封面資訊中可知,Restrictions/Election並非為一般官方審查意見(Office Action)
此例中顯示Claims 1-24被要求進行限制or/and選擇


審查委員認為此案各權利範圍所描述的態樣為獨立(independent)或是有區別的(distinct),並依照各實施例的範圍區分為多個態樣或類別(species),審查委員並指出各態樣所對應的圖式
再說明各權利範圍表達的實施例間並無明顯不同,故僅因審查委員檢索的負擔(search burden)提出選擇要求(election),經審查,若無總的(generic)或是上位的範圍被核准,則需進行限制要求(restriction),申請人應選擇限制於其一態樣的範疇中


在回覆(reply)此要求時,應具備一個態樣的選擇,與提出Claim內容確認所選擇範疇間的依附關係
審查委員更依據法令說明,申請人可反駁此限制選擇要求,並需明確指出此限制選擇的錯誤,否則會被視為無反駁(without traverse)
(實務上,提出反駁的同時,應仍提出一組選擇權利範圍,以免審查委員發出Final Office Action)


相對的,若所選擇的權利範疇為可核准,若此為一總的(generic)標的,其餘未選擇的範圍可以附屬項形式,或是將條件限縮於可核准範圍中,而被核准

審查委員拒絕IDS的實例之一

實務上,審查委員應將規定期限內提出的IDS列入審查考慮,並做出判斷,但是,審查委員仍可因為IDS內容不確實而拒絕考慮(不符37CFR 1.97, 1.98, MPEP 609的規定)

由於IDS中文件的資訊有誤,所以審查委員可不用列入考慮,申請人可於提出OA答辯時,順道更正其中的訊息,或是移除IDS之列,或是如審查委員所要求,重新提出更新的IDS
