專利檢索101 - 美國專利檢索

筆記

經閱讀IPWatchdog文章「Patent Searching 101: A Patent Search Tutorial」後，有了以下一些整理，加上自己的心得筆記。

專利檢索一般有幾個目的：
1. 撰寫新案前的準備，透過檢索前案瞭解相關領域的先前技術，適當迴避；
2. 研發以及產品上市前風險評估；
3. 舉發或無效某專利；
4. 進行專利訴訟前的預備動作，可考慮補充審查（Supplemental examination）；
5. 監控對手專利佈局；
6. 進入市場的準備，如製作專利地圖。

除了大家熟知可以直接使用USPTO官方網站中專利資料庫檢索的方式外，這裡實做IPWatchdog推薦的幾個免費檢索工具。

IPWatchdog建議的檢索網頁：

Free Patents Online（http://www.freepatentsonline.com/）

Free Patents Online實做，使用如USPTO的Advanced Search的參數，沒有太多障礙。

建議檢索步驟：
1. 找到適當關鍵字
2. 找到對應（有興趣）的專利分類
3. 先以專利分類縮小檢索範圍
4. 以USPTO檢索欄位再次縮小檢索範圍，例如：ACLM（專利範圍）、SPEC（專利說明書）、ABST（摘要）
5. 甚至可以繼續找到特定申請人的專利，例如：AN（申請人、專利權人）
